Philip Howard on fixing the legal system

One of my favorite talks at TED this year was Philip Howard's on four ways we could fix our horribly messed up and inefficient legal system. This would be huge:

He is so right it hurts. Could this somehow be done? There must be lawyers out there who could answer that question.

How does he propose to get people to think about the greater good instead of themselves?

This was very interesting. However, I'm skeptical of the general thrust of his argument.

Howard mentions bad outcomes of
-The Americans with Disabilities Act
-Various environmental regulations
-Growth in tort liability

But for my part, I am happy that people in wheelchairs have access to schools, courthouses, and restaurants. I am happy that environmental agencies attempt to leave 'no pebble unturned' on construction projects to make sure that they don't ruin our environment. I am happy that product manufacturers are liable for defective products.

Until the goal of most of society's activity ceases to be brute profit maximization, we will need these legal rules in place.

Laws have unintended consequences, and I appreciate Howard's point about freedom needing red lights and green lights. But the answer to this is not an assault on 'law.'

Freedom for a restaurant owner to lack a wheelchair entrance can result in unfreedom for a wheelchair-bound person. This is a cultural issue and a political issue, and now because of the Americans With Disabilities Act, it is a legal issue. If Howard is proposing to remove this kind of thing from the realm of law, then I cannot jump on board.

I think he is correct about what is contributing to the destruction of America from within. However one thing he did not mention was that there are people in power in our government especially in this current Obama regime who's goal is to help destroy and transform a free America. So that will be toughest hurdle to overcome. I believe the American people will reject the regimes transformation and get back to founding principles and become free again!!!
